Acceptance of terms

Welcome to Scamhound. By accessing or using our email scam detection service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("you," "your," or "User") and Timbrespark Studios ("Scamhound," "we," "us," or "our").

By using our Service, you represent that:

• You are at least 18 years old
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations

Description of service

Scamhound is an AI-powered email analysis service that helps users identify scam, phishing, and fraudulent emails.

Service features:

• Email forwarding and analysis for scam detection
• AI-powered verdict with confidence scoring
• Educational explanations of detection reasoning
• Analysis history dashboard
• Automatic reporting of confirmed scams to relevant authorities
• Email response with recommended actions

Important limitations:

• Scamhound is a tool to assist with scam detection, not a guarantee
• We provide analysis based on available information at the time
• False positives and false negatives may occur
• We are not liable for any decisions you make based on our analysis
• The Service should supplement, not replace, your own judgement

User accounts and registration

Account types

Anonymous users may analyze up to 3 emails total without registration. No account creation is required, but access to history is not available.

Free registered users must create an account with a valid email address. May forward up to 10 emails per calendar month with access to dashboard and analysis history. Usage resets on the 1st of each month.

Paid subscribers receive unlimited email analyses, all free account features, and priority support (future feature). Subscription is billed monthly or annually.

Account creation

When you create an account, you agree to provide accurate, current, and complete information; maintain and update your information as needed; keep your password secure and confidential; notify us immediately of any unauthorized access; and accept responsibility for all activities under your account.

Account security

You are responsible for maintaining the security of your account. We are not liable for any loss or damage from your failure to maintain account security.

Service tiers and usage limits

Free tier limitations

Free tier users are subject to 10 email analyses per calendar month. Usage counter resets on the 1st of each month. After reaching the limit, you must upgrade to continue using the Service.

Anonymous usage

Anonymous users may analyze 3 emails total before account creation is required. They cannot access analysis history but may claim their anonymous history upon account registration if using the same email address.

Fair use policy

Even for paid subscribers, we reserve the right to implement reasonable usage limits to prevent abuse. Abuse includes automated or scripted submissions, reselling or redistributing our Service, using the Service in ways that could harm our infrastructure, submitting the same email repeatedly, or commercial use without a commercial agreement.

Payment terms

Subscription fees

• Monthly plan: $4.99 per month, billed monthly
• Annual plan: $49.00 per year, billed annually (save approx. 18%)
• Prices are in USD and exclude applicable taxes
• Prices are subject to change with 30 days' notice to existing subscribers

Billing and renewal

• Automatic renewal: Subscriptions renew automatically unless cancelled
• Payment method: We accept major credit cards via Stripe
• Billing cycle: Charges occur on your subscription start date each period
• Failed payments: We will attempt to charge your card up to 3 times over 7 days
• Service suspension: Accounts with failed payments will be downgraded to free tier

Refunds

• Monthly subscriptions: No refunds for partial months; service continues until period ends
• Annual subscriptions: Pro-rated refund available within 30 days of initial purchase
• After 30 days: No refunds for annual subscriptions
• Exceptional circumstances: We may offer refunds at our sole discretion

Cancellation

You may cancel your subscription at any time through your account settings. Your access continues until the end of the current billing period, with no charges after that period ends.

Acceptable use

Permitted uses

You may use Scamhound to analyze suspicious emails you have received, learn about scam tactics and email security, protect yourself from fraud and phishing attempts, and track your scam detection history.

Prohibited uses

You may NOT use Scamhound to:

• Submit emails that contain illegal content
• Violate any person's privacy or intellectual property rights
• Submit malware, viruses, or malicious code
• Attempt to reverse engineer, decompile, or hack our Service
• Resell, redistribute, or commercialize our Service without authorization
• Submit emails on behalf of others without permission
• Use the Service to spam, harass, or harm others
• Bypass or circumvent usage limitations
• Scrape, crawl, or index our Service without permission
• Impersonate others or misrepresent your affiliation
• Interfere with or disrupt the Service or servers

Repeated violations may result in permanent account termination without refund. See our Acceptable Use Policy for the complete list of rules and enforcement procedures.

Intellectual property

Our rights

Scamhound and all related content, features, and functionality are owned by us and protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, create derivative works, distribute, sell, or transfer any part of the Service, or remove copyright or proprietary notices.

Your content

When you submit emails to our Service, you retain ownership of your original content. You grant us a license to process, analyze, and store submitted emails for Service provision and improvement. We may use anonymized, de-identified patterns for AI training. We will not share your specific email content with third parties except as outlined in our Privacy Policy.

Feedback

If you provide feedback, suggestions, or ideas about our Service, we may use them without obligation or compensation to you. You grant us a perpetual, royalty-free license to implement your feedback.

Third-party services

Our Service integrates with third-party services:

• Email infrastructure (Mailgun): Processes inbound and outbound emails, subject to Mailgun's terms and privacy policy
• AI analysis (Anthropic Claude): Powers our scam detection, subject to Anthropic's terms and privacy policy
• Payment processing (Stripe): Handles all payment transactions, subject to Stripe's terms and privacy policy

We are not responsible for the actions, policies, or practices of these third parties. We encourage you to review their terms and policies.

Disclaimers and limitations of liability

Service provided "as is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, uninterrupted access, or security of data transmission.

No professional advice

Scamhound is a tool for information purposes only. It does not provide legal advice, financial advice, professional cybersecurity services, or guaranteed protection against fraud. You should not rely solely on our Service for important decisions.

Accuracy disclaimer

While we strive for accuracy, our AI analysis may produce false positives (flagging legitimate emails as scams) or false negatives (missing actual scams). Scam tactics evolve constantly and may evade detection. We make no guarantees about detection accuracy and are not liable for any consequences of our analysis being incorrect.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or business opportunities; service interruptions; errors, bugs, or inaccuracies; unauthorized access to your data; third-party actions or content; or your reliance on our analysis.

Our total liability to you for any claims arising from these Terms or use of the Service shall not exceed the greater of $100 USD or the amount you paid us in the 12 months preceding the claim. These limitations do not apply where prohibited by law or to our gross negligence or wilful misconduct.

Indemnification

You agree to indemnify, defend, and hold harmless Scamhound, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any rights of another party, or your violation of applicable laws.

Termination

Termination by you

You may terminate your account at any time by deleting your account through account settings, emailing us at [email protected], or ceasing to use the Service. Upon termination, your subscription will be cancelled and your data will be deleted according to our Privacy Policy.

Termination by us

We may suspend or terminate your account immediately without notice if you violate these Terms, engage in fraudulent activity, have an account inactive for 2+ years, if we discontinue the Service (with 60 days' notice), if required by law or legal process, or if your payment method fails repeatedly.

Effect of termination

Upon termination, your right to use the Service ends immediately. Provisions that should survive termination (disclaimers, indemnification, etc.) will survive. Outstanding fees remain due.

Data and privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to collection of information as described in our Privacy Policy, processing of forwarded emails for scam analysis, use of anonymized data to improve our AI models, and reporting of confirmed scams to relevant authorities.

While we implement reasonable security measures, we cannot guarantee absolute security. You acknowledge that internet transmission is never completely secure and you assume the risk of transmitting information over the internet.

Authority reporting

Automatic reporting

When our analysis detects a high-confidence scam (>80% confidence), we automatically report to the FBI's Internet Crime Complaint Center (IC3) for US-based emails and the UK's Suspicious Email Reporting Service (SERS) for UK-based emails. All personally identifiable information is stripped before reporting.

Your consent

By using our Service, you consent to these automatic reports. Reported information may be used by authorities in investigations, and you cannot opt-out of this reporting while using the Service. We have no control over how authorities use reported information.

Modifications to terms

We reserve the right to modify these Terms at any time. For minor changes, we will update the "Last Updated" date and continued use constitutes acceptance. For material changes, we will notify you via email or prominent notice on the website at least 30 days before changes take effect. You may terminate your account if you disagree with changes.

General provisions

Governing law

These Terms are governed by and construed in accordance with the laws of Pennsylvania, United States, without regard to conflict of law provisions.

Dispute resolution

Before filing a claim, you agree to contact us at [email protected] to attempt informal resolution. We will respond within 30 days. Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). You agree to bring claims individually, not as part of a class action or representative proceeding.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to be enforceable to the maximum extent possible. All other provisions remain in full effect.

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scamhound regarding the Service and supersede all prior agreements.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.

Force majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, government actions, internet outages, or third-party service failures.
